platform "Tendeal”, offering a range of impactful services and features

along with any additional regulations published on our platform, collectively
constitute "The Terms and Conditions." We strongly encourage you to
thoroughly review these provisions before initiating your registration requests
on Tendeal. As a proactive measure, we recommend retaining a copy of these
terms and conditions for your convenience and reference in the future.
These Terms and Conditions might be amended from time to time. And shall be applied on all our services directly or indirectly. By accessing, browsing and using our website or any of our applications through whatever platform (hereafter collectively referred to as the "Platform") and/or by completing a registration, you (Customer/s, Visitor/s, User/s,) acknowledge and agree to have read, understood and agreed to the terms and conditions set out below (including the privacy statement).
These
pages, the content and infrastructure of this Platform, and the online selling
service provided on this Platform are owned, operated, and provided by
ALTENDEALS for electronic commerce W.L.L (" tendeal .qa",
“tendeal app”, "us", "we" or "our") and your use
is subject to the Terms and Conditions set out below.
Tendeal is the commercial name for ALTENDEALS
for electronic commerce W.L.L, and it's a registred company in Qatar under
registration number 149178. Our registred address is Zone 38, Building 83,
Street 231, Office 16, Doha, Qatar, P.O Box 10150.
Within this
Platform, we extend online marketing and promotional services the merchants and
brands willing to advertise on Tendeal website and/or Tendeal app.
Additionally, our Platform allows users and merchants to access the services
provided by the service providers. When you engage in activities such as
ordering, selling, or requesting services through Tendeal, you acknowledge and
accept that you are entering into a direct agreement with the respective
service provider. As such, you will be bound by the terms and conditions
specified by the service provider concerning the services in question. It's
important to note that Tendeal acts as an intermediary between you and the
service provider. We facilitate this connection and, upon your provision of an
email address, send a confirmation email validating your order. This process
emphasizes our role as a mediator and aims to ensure a seamless experience for
all parties involved.
As we
extend our services to you through this platform, it's essential to understand
that the information presented here is provided by the service providers
themselves. Consequently, these service providers bear full responsibility for
keeping all prices, availability, and other displayed information up to date on
our platform. While we maintain a commitment to performing our services with
reasonable skill and care, we must emphasize that we cannot guarantee the
accuracy and efficiency of this information. Furthermore, we cannot assume
responsibility for any errors, interruptions (whether arising from temporary
breakdowns, repairs, upgrades, maintenance of our platform, or other factors),
inaccuracies, misleading content, or non-delivery of information. Please note

on our platform, including prices and availability, fall under the
responsibility of the service provider. It's important to recognize that our

The Service Providers bear exclusive responsibility for the quality and
execution of the services they offer. Tendeal's role is confined to providing
the platform itself. The online Payment Gateways accessible via Tendeal are
owned and managed by third-party payment providers, including, Visa, and
Mastercard (collectively referred to as the "Payment Gateways"). Both
the Customer and the Service Provider concur that Tendeal holds no liability
for the services provided by the Payment Gateways providers. The Customer
acknowledges and agrees not to initiate any legal actions against Tendeal
concerning the services provided by the Payment Gateways providers.
The Platform is accessible to both Customers and Service Providers when it's online. Tendeal reserves the right to temporarily take the Platform offline for reasons it deems fit, or modify its content and services without prior notification. Tendeal cannot be held accountable if, for any reason, the Platform or any portion of it becomes unavailable during any period. It's important to note that the Customer bears sole responsibility for any third-party access to the Platform using their credentials.
Misuse of the Platform
By utilizing the Platform, you assert that all
personal information you provide is truthful, complete, and accurate. You
retain the ability to update this information whenever necessary and accept
full responsibility for any losses arising from misrepresentations. It is
imperative to acknowledge that you will bear personal accountability for any
inappropriate use of the Platform. In the event that any of the following
actions occur, Tendeal reserves the right to initiate legal proceedings
against you:
a. Introducing knowingly harmful elements such as
viruses, Trojans, worms, logic bombs, time bombs, keystroke loggers, spyware,
adware, or other materials that negatively affect computer software or
hardware, or are designed to do so, on the Platform.
b. Attempting to or succeeding in unauthorized
access to the server where the Platform is hosted, or any server, computer,
or database linked to the Platform.
c. Launching an attack on the Platform through
denial-of-service or distributed denial-of-service tactics; and
d. Utilizing the Platform in a manner that contravenes the law or public policy.
We would like to particularly draw your attention to our registration policy stated in our terms and conditions and privacy policy.
If your age is under 16 years, you must tell your parents or guardian about the privacy policy of Tendeal before you register to use this website or any of its services.
We are entitled to accept the registration requests of those who are over the age of 18 only.
We are entitled to amend the terms and conditions from time to time. Please usually read and check the terms and conditions. If you don’t approve any change in the terms and conditions; you should immediately stop using the Platform.
Any change made in the terms and conditions after your registration request is proceeded will not affect your registration request unless this change is made as per the law.
Registration
In order to be able to use some of the services and accessibility available to you through the Platform, you must register first if you are not just a visitor. Tendeal reserves the right to suspend or cancel any registration or login data /access to the Platform in case of User misuse of the Platform in particular with the data submitted by the customer as set out in a later section.
Tendeal shall not be liable for any loss or damages whatsoever arising from a user's inability to access any pages on the Platform.
Member Acccount, Password, and Security
You are responsible for maintaining the
confidentiality of your password and account and are fully responsible for
any and all activities that occur under your password or account. You agree
and acknowledge that you may only create one account. You agree to:
- Immediately notify Tendeal of any unauthorized use of your
password or account or any other breach of security.
- Ensure that you exit from your account at the end of each session when
accessing the Platform. Tendeal will
not be liable for any loss or damage arising from your failure to comply with
this section.
Correspondence and Communication
By completing an. order, you agree to receive:

giving you information on your order and providing you with certain
information and offers (including third party offers) relevant to your orders
and services.

Data Submitted by the User
The Customer can create his own account on the Platform through his login data which will give him access to further features, content and special promotions on the Platform.
The Customer can, at any time delete his account by
sending an e-mail to our customer service (info@tendeal.qa) . An email which we may send
you after your service asking you to complete your service experience review.

you will deactivate the account in a timely manner.
All content submitted to or uploaded on the Platform
by any User through his account, including without limitation, personal data,
contact details, usernames, pseudonyms, text, comments, reviews, images, and
all other information must be true, complete, correct and shall not offend
any third party´s right and shall not in any way be considered against public
policy or public morale or the applicable laws in the state of Qatar.
The User agrees that Tendeal may, in its sole discretion, amend
or delete any content, before or after publication or refuse the publication.
The User warrants, represents and undertakes to Tendeal that his DATA shall not:
a- infringe the copyrights or database rights,
trademarks, rights of privacy, publicity or other intellectual property or
other rights of any other person or entity;
b- contain any material which is defamatory of any
person;
c- contain misleading or deceptive statements or
omissions or misrepresentation as to identity (or his affiliation with any
person or entity;
d- breach any legal or fiduciary duty owed to a
third party, such as a contractual duty or a duty of confidence;
e- advocate, promote, or assist discrimination based
on race, sex, religion, nationality, disability, sexual orientation or age;
f- shall not violate any other applicable law,
statute, ordinance, rule or regulation.
g- shall not violate the duly registered
intellectual property`s rights for others.
Should the data submitted by the user not be
compliant with the applicable law or the above set rules, and as a result of
this, should Tendeal suffer a loss or damage, the USER shall be
held liable and the USER agrees to indemnify Tendeal for all such loss or damage.
Should the data submitted by the user have criminal
implications, Tendeal reserves the right to pass it on to the
relevant authorities and to disclose the Customer´s identity to any third
party who claims that any of the user data constitutes a violation of any of
their rights.
Apart from personal data which are protected
according to the law and to the Privacy Policy, any other user data submitted
to the Platform will be considered non-confidential and non-proprietary.
All user data posted on the Platform will be linked
to the user's username provided at the time of registration.
Registration Validity
In order to proceed with registration on the
website; you’ll be requested to provide your personal data, particularly, you
first name and sur name, phone number, email and other required information
as specified.
In
addition, you approve that we might use the personal information you
submitted to us to implement the appropriate checking procedures against
fraud. Your personal information submitted to us might be disclosed to the
credit reference service or a fraud control agency, which might maintain a
log for that information.
Orders
If
You are (Registered or Visitor) you can use the search engine on the Platform
to find a Service Provider (e.g. services , products , services providers ).
By
ordering through the platform You accept, the Privacy Policy and concludes
the contractual relationship with the Service Provider.
The
order process allows you to check and amend any errors before submitting the order.
If you choose to pay online, you must retain a copy of the transaction
records.
Price, Payment and Invoicing
The prices for the services are displayed on the Service
Provider´s profile page on the Platform and may vary from time to time upon the
sole discretion of the Service Provider,
The Platform contains details of a number of
services and it is possible that, despite Tendeal best efforts, some of the prices and
other information shown by the Service Provider on the Platform for certain services are
incorrect / not updated as which is
the Service Provider ’s sole responsibility to keep its information accurate.
Any charges incurred in making an online payment shall
be borne by the Service Provider.
Tendeal accepts payments online using debit cards
and credit cards (Visa, MasterCard),
Tendeal takes reasonable care to ensure that the
Online Payment Gateway is available and functioning at all times, but cannot
guarantee continuous and uninterrupted access to such Payment Gateway as it
is owned and operated by a third-party. Tendeal also tries to ensure that Customer´s
payments are processed promptly, but it is often difficult to predict the
amount of time needed to complete processing because it is dependent upon
many factors outside of Tendeal control,
such as delays in the banking system or in card networks. Access to the
Online Payment Gateways may be occasionally restricted to allow for repairs,
maintenance or the introduction of new facilities or services. Tendeal will attempt to provide reasonable notice of any scheduled interruptions
to such Payment Gateway and will use its best effort to procure the
restoration of the Payment Gateway as soon as reasonably possible.
For the orders it is possible for the Customers to
choose to “cash on delivery). According to this option the Customer can place
an order on the Platform but eventually pay for service provider directly at
the time of the appointed delivery. This option appears on the Platform at
the time of the order process. Please note that the way of payment does not
change the other content of the contractual relationship between service
provider and customer.
Complaints
If you are not satisfied with the Services provided
by the Service Provider, you may directly, at the time of the service,
complaint to Service Provider.
If you have an issue with the Payment Gateway, you
may contact with Payment gateway Service Provider.
In order to improve or keep a high-quality Service Provider ´s Services,
Customers can also leave their review on the relevant Service Provider's page
on the Platform. However, such review cannot be offensive, misrepresentative or
false.
Refunds
If you decide to pay online throughout our payment
gateway and then after you decide to cancel the service and Tendeal agree with subject to this Terms and
Conditions, the money will be refunded to you after deducting any fees
applied by the bank.
If you wish to review, adjust, or cancel your order, please revert to
the confirmation email and follow the instructions therein.

Intellectual Property
Tendeal contains content & features that are
protected by copyright, patent, trademark, trade secret and other proprietary
rights and laws. Except as expressly authorized by Tendeal Customers and Service Provider’s
agree not to modify, copy, frame, scrape, rent, lease, loan, sell, distribute
or create derivative works based on the Platform or the Platform Content, in
whole or in part. In connection with your use of the Platform you will not
engage in or use any data mining, robots, scraping or similar data gathering
or extraction methods. Any use of the Platform or the Platform Content other
than as specifically authorized herein is strictly prohibited. The technology
and software underlying the Platform or distributed in connection therewith
is the property of Tendeal . Any user of the Platform agrees not to copy,
modify, create a derivative work of, reverse engineer, reverse assemble or
otherwise attempt to discover any source code, sell, assign, sublicense, or
otherwise transfer any right in the Software.
The Users may download and/or print out the content
of the Platform only for personal, non-commercial use.
The User is not entitled to change, modify and/or
(re)-edit the digital or hard copies of any particular content of the
Platform and/or add, modify and/or (re-)use certain photographs, texts,
(graphic) images and/or video and/or audio content to the original content of
the Platform.
As stated above, no part of the Platform (in whole
or in part) may be published in any way, duplicated, transmitted,
distributed, reproduced, copied, modified and/or in any other way used or
exploited (including but not limited to reproduction or storage on other
website(s) or any electronic (storage) device) .
Tendeal reserves all rights regarding the https://www.tendeal.qa domain name
and all related domains and sub-domains. Tendeal name and logos are trademarks and service
marks of Tendeal Other company, product, and service names and logos used and
displayed via the Platforms may be trademarks or service marks of their
respective owners who may or may not endorse or be affiliated with or
connected to us. Nothing in this Terms & Conditions or the Platform
should be construed as granting, by implication, estoppel, or otherwise, any
license or right to use any of Tendeal
Trademarks displayed on the Platforms, without our prior written permission
in each instance.
Under no circumstances will Tendeal be liable in any
way for any content or materials of any third parties (including users),
including, but not limited to, for any errors or omissions in any content, or
for any loss or damage of any kind incurred as a result of the use of any
such content. Tendeal will have the
right (but not the obligation) in their sole discretion to refuse or remove
any content that is available via the Platform. Without limiting the
foregoing, Tendeal will have the right
to remove any content that violates these Terms and Conditions or is deemed
by Tendeal , in its sole discretion,
to be otherwise objectionable. The user agrees to evaluate, and bear all
risks associated with, the use of any content, including any reliance on the
accuracy, completeness, or usefulness of such content.
The User acknowledges and agrees that Tendeal may preserve content and may also
disclose content if required to do so by law or in the good faith belief that
such preservation or disclosure is reasonably necessary to:
a- comply with legal process, applicable laws or
government requests;
b- enforce these Terms and Conditions;
c- respond to claims that any content violates the
rights of third parties; or
d- protect the rights, property, or personal safety
of Tendeal , its users and the public.
The user understands that the technical processing
and transmission of the Platform, including his/her content, may involve
- transmissions over various networks; and
- changes to conform and adapt to technical
requirements of connecting networks or devices.
Third party Content and Third Party Website
Tendeal may
contain advertising submitted by third parties. Such third parties are solely
responsible for the content of such advertising and for ensuring that it
complies with all relevant legislation and regulations. Tendeal will not be held responsible for the
content of any third-party advertisements.
The Platform and/or the contents may contain links
to third -party websites and social media accounts (including those that
belongs to the Service providers). If the Customer decides to visit any third-party
site, or social media account he/she do this at his/her own risk. Tendeal is not responsible or liable
directly or indirectly for the content, accuracy or opinions expressed in
such websites or accounts or the standard of goods or services available
through or on such websites or accounts. Unless otherwise expressly stated herein, links do
not imply that Tendeal or the Platform
is, affiliated to or associated with such sites or accounts.
Tendeal communications with the Customer may contain
information sourced from third party websites. Content from a third-party
site will be marked as such and a link to the source website may be provided.
Tendeal accepts no responsibility or
liability for any content supplied by or contained on any third-party
website.
The inclusion of any link in Tendeal communication with the Customer does not
imply endorsement by it of the linked site. If a Customer decides to access
linked third-party websites, he does so at his own risk.
Please remember that when a Customer uses a link to go from the Platform
to another website, the Privacy Policy will no longer be applicable.
Third Party Website
The Platform may provide, or third parties may provide, links or other access to other sites, resources on the Internet and/or third party provided content such as coupons and promotional media. Because Tendeal has no control over such sites and resources and content and materials, the user agrees and acknowledges that Tendeal is not responsible for the availability of such external sites or resources and content and materials and does not endorse and is not responsible or liable for any content, advertising, coupons, products or other materials made available from such sites or resources. The user further acknowledges and agrees that Tendeal will not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any content, events, goods or services available on or through any such site or resource. Any dealings the user has with third parties found while using the Platform are between him/her and the third party, and the user agrees that Tendeal is not liable for any loss or claim that the user may have against any such third party.
Liability Limitation
Tendeal is not responsible whatsoever for the Services provided by the Service Providers.
Tendeal is not responsible whatsoever for the Online Payment Gateway, Tendeal declares, and the Customer acknowledges to be aware that it is operated by a third payment service provider company.
Tendeal is
only responsible for the function of the Platform, however Tendeal may, in its sole discretion, operate
the Platform as it deems necessary.
Under no circumstances whatsoever will Tendeal be liable for any indirect damage,
consequential damage or moral damage.
Tendeal shall not be responsible for the inaccuracy
of the content generated on the Platform directly by the Service Provider. It
is not Tendeal duty to control the accuracy of such
content. The content of the Platform may contain typing and/or material
errors for which Tendeal shall not be held responsible.
Tendeal reserves the right to terminate accounts
that are inactive for an extended period of time. And reserves the right to
change these general practices and limits at any time, in its sole
discretion, with or without notice.
Tendeal reserves the right to modify or discontinue,
temporarily or permanently, the Platform (or any part thereof) with or
without notice. Users agree that Tendeal will not be liable to you or to any
third party for any modification, suspension or discontinuance of the
service.
Modification to Services
The User acknowledges that Tendeal may establish general practices and limits concerning use of the Platform, including without limitation the maximum period of time that data or other content will be retained by the Platform and the maximum storage space that will be allocated on Tendeal servers on the customer's behalf. The User agrees that Tendeal has no responsibility or liability for the deletion or failure to store any data or other content maintained or uploaded by the Platform.
Conditions of Use
User Conduct:
The user agrees to not use the Platform to:
Interfere with or disrupt the Platform or servers or
networks connected to the Platform, or disobey any requirements, procedures,
policies or regulations of networks connected to the Platform;
Violate any applicable national or international
law, or any regulations having the force of law;
Impersonate any person or entity, or falsely state
or otherwise misrepresent his/her affiliation with a person or entity;
Solicit personal information from anyone under the
age of 18;
Harvest or collect email addresses or other contact
information of other users from the Platform by electronic or other means for
the purposes of sending unsolicited emails or other unsolicited communications;
Advertise or offer to sell or buy any goods or
services for any business purpose that is not specifically authorized;
Further or promote any criminal activity or
enterprise or provide instructional information about illegal activities;
Reverse engineer, decompile, disassemble or
otherwise attempt to discover the source code, object code or underlying
structure of the Platform; or
Obtain or attempt to access or otherwise obtain any
materials or information through any means not intentionally made available
or provided for through the Platform.
Commercial Use: Unless otherwise expressly authorized herein or in the
Platform, you agree not to display, distribute, license, perform, publish,
reproduce, duplicate, copy, create derivative works from, modify, sell, resell,
exploit, transfer or upload for any commercial purposes, any portion of the
Platform, use of the Platform, or access to the Platform. The Platform is for
your personal use.
Your Activity on the Platform
You agree to be personally responsible for using this website and for your communications and activity on the website as per the Terms and Conditions of the website. If we realize that you have contributed or are contributing to prohibited activities and you didn’t respect the other users, or that you have violated the terms and conditions; we might prevent you temporarily or permanently from logging in to the website, you also shall bear the civil or criminal responsibility for this.
CompensationBased on our demand, you hereby agree to completely compensate us, defend us and discharge Tendeal immediately upon our request, along with its employees, managers, agents, affiliated companies, licensing entities and suppliers from and against all obligations, claims, expenses and damage and loss compensation including the legal fees resulted from your violation for the terms and conditions, and including using the website by other people that login to this website using your own account whether you helped in this or not.
Nature of Relationship
You shall acknowledge that there’s no joint venture, partnership, work relationship or power of attorney relationship between you and Tendeal as a result for the terms and conditions or using this website. You shall agree that you don’t and will not consider yourself as a representative or employee for Tendeal, and we will not be responsible for any representation, act or negligence from your side.
No waiver
If you violate the Terms and Conditions and we don’t take any action against you; we shall remain entitled to use our rights and penalties in any other situation in which the terms and conditions are violated.
Termination
The User agrees that Tendeal in its sole discretion, may suspend or terminate his/her account (or any part thereof) or use of the Platform and remove and discard any content within the Platform, for any reason, including, without limitation, for lack of use or if Tendeal believes that he/she has violated or acted inconsistently with the letter or spirit of these Terms and Conditions. Any suspected fraudulent, abusive or illegal activity that may be grounds for termination of his/her use of Platform, may be referred to appropriate law enforcement authorities. Tendeal may also in its sole discretion and at any time discontinue providing the Platform, or any part thereof, with or without notice. The User agrees that any termination of his/her access to the Platform under any provision of these Terms and Conditions may be effected without prior notice, and acknowledges and agrees that Tendeal may immediately deactivate or delete his/her account and all related information and files in his/her account and/or ban any further access to such files or the Platform. Further, the User agrees that Tendeal will not be liable to the user or any third party for any block of his/her access to the Platform.
DisclaimerTo the extent permitted by law, neither we nor any of our officers, directors, employees, representatives, subsidiaries, affiliated companies, distributors, affiliate (distribution) partners, licensees, agents or others involved in creating, sponsoring, promoting, or otherwise making available the site and its contents shall be liable for:
(i) any punitive, special, indirect or
consequential loss or damages, any loss of production, loss of profit, loss
of revenue, loss of contract, loss of or damage to goodwill or reputation,
loss of claim, (ii) any inaccuracy relating to the (descriptive) information
(including rates, availability and ratings) of the services as made available
on our website, (iii) the services rendered or the products offered by the
service provider or other business partners, (iv) any (direct, indirect,
consequential or punitive) damages, losses or costs suffered, incurred or

death, property damage, or other (direct, indirect, special, consequential or

or (wholly or partly) attributable to the service or any of our other
business partners (including any of their employees, directors, officers,

strike, force majeure or any other event beyond our control.
By uploading photos/images to the Platform the customer certifies,
warrants and agrees that he/she owns the copyright to the photos/images and
that he/she agrees that Tendeal may use
the uploaded photos/images on its (mobile) website and app, and in
(online/offline) promotional materials and publications and as Tendeal
at its discretion sees fit. The customer is granting Tendeal
a non-exclusive, worldwide, irrevocable, unconditional, perpetual right and
license to use, reproduce, display, have reproduced, distribute, sublicense,
communicate and make available the photos/images as Tendeal
at its discretion sees fit. By uploading these photos/images the person
uploading the picture(s) accepts full legal and moral responsibility of any and
all legal claims that are made by any third parties due to Tendeal publishing and using these
photos/images. Tendeal does not own or endorse the

all photos/images is assumed by the person who uploaded the photo and is not
the responsibility of Tendeal. Tendeal
disclaims all responsibility and liability for the pictures posted. The person
who uploaded the photo warrants that the photos/images shall not contain any
viruses, Trojans or infected files and shall not contain any pornographic,
illegal, obscene, insulting, objectionable or inappropriate material and does
not infringe any third party (intellectual property right, copyright or
privacy) rights. Any photo/image that does not meet the aforesaid criteria will
not be posted and/or can be removed/deleted by Tendeal.
Governing Law and Disputes Resolution
Any dispute arising out of interpretation, performance or execution of any part of this Terms and Conditions, shall be determined in accordance with the laws of State of Qatar, without giving effect to conflict of laws principles. Such dispute shall irrevocably be submitted to the jurisdiction and venue of the courts of state of Qatar.
The Customer is solely responsible for his/her interactions with any service provider or other user in connection with the Platform and Tendeal will have no liability or responsibility with respect thereto. Tendeal reserves the right, but has no obligation, to attempt resolving the dispute between a customer and any service provider or other user of the Platform. In the event of any issue and/or dispute with a service provider.

office translation only and you cannot derive any rights from the translated
version. In the event of a dispute about the contents or interpretation of

English version and Arabic version of these terms and conditions, the Arabic
language version to the extent permitted by law shall apply, prevail and be

written request.
If any provision of these Terms and Conditions is or becomes invalid,
unenforceable or non-binding, the remaining terms and conditions shall be
continuing bound and effective. In such event, such invalid provision shall
nonetheless be enforced to the fullest extent permitted by applicable law, and
you will at least agree to accept a similar effect as the invalid,
unenforceable or non-binding provision, given the contents and purpose of these
terms and conditions.
